REMOVE FAMILY MEMBER OR GIRLFRIEND FROM FLORIDA HOME

If you own a property in the State of Florida and have either a family member, girlfriend, or boyfriend currently residing in the property that you no longer want living there, you have the right as the property owner to remove them.

This removal process is known as an Unlawful Detainer.  The Unlawful Detainer process is governed by Florida Statutes, Chapter 82 and unlike the standard Eviction, the Unlawful Detainer process does not require a lease or rent be paid for use of the property.

The benefit of removing someone through the Unlawful Detainer process is that it tends to be quicker than the Eviction Process. Specifically, although we always recommend doing so, you are not required to give formal notice to the person illegally occupying your property.

If you are a property owner and are unsure if you have a case for an Unlawful Detainer, it is important that your case meets the specific requirements:

  1. There was never a lease between the property owner and the occupant nor was there ever rent exchanged between the parties;
  2. The property owner requested the occupant vacate the property, but the occupant refuses to do so; and
  3. The family member, girlfriend, or boyfriend does not have any legal or equitable interest in the property.

It is very important that if you file an Unlawful Detainer action against a family member, girlfriend, or boyfriend that you want to remove from your property that your case meets all three requirements. If your case does not meet these requirements, but you have already filed your case, there is a possibility that the Judge may dismiss your case as the improper action was filed or stop the case until the case is in proper order.

Therefore, if you are a property owner in the State of Florida and want to remove a family member, girlfriend, or boyfriend from the property, it is very important that you consult an attorney that is experienced in filing Unlawful Detainer Actions.
